Introductory information relating to Tree Preservation Orders / TPOs in Birmingham and the West Midlands | Indigo Surveys can provide advice and support in respect of Trees and TPOs

If you are a home or land owner or are working on behalf of a client who may own trees, you may be aware of Tree Preservation Orders (continually refereed to as TPOs) and the potential considerations which they present.

As Tree Consultants operating throughout the West Midlands, we work regularly with Homeowners, Homebuyers, Solicitors, Insurers, Local Authorities, Developers, Construction Companies, Architects etc., to provide advice on Trees and TPOs.

A TPO is an order made by your Local Planning Authority to safeguard the amenity provision of trees (sometimes tree groups / land areas) or woodlands which are considered appropriate for protection. Simply put, TPOs are used to prohibit the (1) cutting down, (2) uprooting, (3) topping, (4) lopping, (5) wilful damage or (6) wilful destruction of the trees or woodlands without the LPA’s consent.

Many Local Authorities have website sections relating to Trees and more specifically, such as with Birmingham City Council, advice relating to the implementation of tree preservation (Tree Preservation – Birmingham City Council). Furthermore, an online search allows you to check the presence of TPOs and/or location within a Conservation Area (TPO Check – Birmingham City Council).

The presence of a TPO can be a material consideration in a number of circumstances, i.e. proposed works to trees, construction at site. You should take further advice in order to comply with legislation and carry out the necessary action.

Should you require assistance, we are client focused with good Local Authorities relationships (inc. Tree Officers), this allows us to bring a swift resolve to TPO matters and advise on the appropriate action.

We are more than happy to provide you with free verbal advice and review any TPO documents you wish to send us initially. In the meantime, check out our website sections for further information, i.e. our BS5837 Information or BS5837 Tree Report services.

Feel free to contact a Tree Consultant on 0333 123 7080 or info@IndigoSurveys.co.uk – we look forward to hearing from you.

The current copy of BS5837 'Trees in Relation to Construction - Recommendations' was published in 2005 which has been 'fully revised by a specialist panel' - public consultation closed in June 2011.

Latest revision to BS5837 ‘Trees in Relation to Construction Recommendation – Consultation’

The current copy of the guidance was published in 2005 which has been ‘fully revised by a specialist panel’. Public consultation closed in June 2011 and the new revisions are eagerly anticipated which will update on the currently tested 2005 version.

Particular mention of changes include recognition for:

• All situations where trees might be impacted by construction related changes;

• Young trees and their importance to canopy cover and climate adaptation;

• Associated guidance, i.e. The Royal Institute of British Architects (RIBA) work programme;

• The importance of new landscaping in the design process rather than as a planning condition; and

• Recent changes in construction methods and updates to the Building Regulations.

BSI detail the history of BS5837 such that “the first edition of the standard was published in January 1980 as a ‘code of practice’. In December 1991 the standard was published as a ‘guide’. In September 2005 it was published with an upgraded status of ‘recommendations’. In May 2011 the draft will be published for industry comment.”

ForestXplorer – Forestry Commission iPhone App

The Forestry Commission has launched a great new free iPhone App which helps you explore England’s forests.

It helps you find new places, plan your visit, navigate around the forests and woodlands with the useful ability to identify tree species and search by tree type of by identifying the features such as leaves and bark type.

The app seems to be a great tool to help discover our forests and woodlands and enjoy the features within them. The addition of directions, opening times and contact details for further advice seems to be well received with some good reviews so far.

You can view and download the ForestXplorer App from iTunes.
